Abstract:This document was submitted to the 10th District Federal Appeals Court in Washington DC on March 13, 2006 as part of the ongoing appeal of the FCC Report and Order brought by the higher education community. The FCC Report was issued August 5, 2005 and dealt with the applicability of the Communications Assistance for Law Enforcement Act. This document contains arguments in response to those submitted by the FCC and the DoJ in this case.

Abstract:This is a formal appeal of the FCC ruling concerning CALEA filed in the 10th District Court of Appeals. The document states that we are asking the Court to overturn the FCC ruling based on the evidence given in the Brief. This document combines the arguments of all the petitioners. This Brief represents the first formal submission of evidence, there be an oral argument later this spring.

Abstract:On September 23, the Federal Communications Commission released an Order and Further Notice of Public Rule Making applying for the first time the Communications Assistance for Law Enforcement Act (CALEA) to facilities-based broadband Internet access providers, including higher education institutions, K-12 schools, libraries, and interconnected Voice over Internet Protocol (VoIP) service providers. The Order requires these entities to facilitate lawful requests for surveillance of specific communications on their data networks through a combination of new equipment, trained personnel, policies, and procedures, to be in place within 18 months of the filing of the ruling in the Federal Register.
