 <title>EDUCAUSE signs on to 700 MHz Comments to the FCC</title>

 <description>As part of the Ad Hoc Public Interest Spectrum Coalition, EDUCAUSE signed on to comments submitted to the FCC regarding the auction rules for the 700 MHz spectrum. This valuable spectrum is expected to be auctioned off in January 2008. The comments ask the FCC to establish rules that would help facilitate a viable third provider for broadband access that would not only provide much needed competition, but would be required to adhere to basic non-discrimination rules. Considerations include rules for: anonymous bidding, exclusion of incumbents or new entrant credit, band plan issues, build-out requirements, designated entities, open access, Carterphone and net neutrality.</description>

 <title>Comments of the Ad-Hoc Public Interest Spectrum Coalition In the Matter of Skype Communications S.A.R.L</title>

 <description>On April 30, 2007 EDUCAUSE, as part of the Ad Hoc Public Interest Spectrum Coalition, submitted comments in the Skype Communications proceeding (RM-11361) at the FCC.  These comments support the idea that as broadband access becomes increasingly available over wireless phones, principles that applied to the wireline development of the Internet need to be applied to wireless access as well. These include the principles of: being able to attach any device to the network as long as it does not damage the network (known as the Carterfone principle), non-discrimination, and basic consumer protection.</description>

 <title>FCC Order and Further Notice of Public Rulemaking on CALEA</title>

 <description>On September 23, the Federal Communications Commission released an Order and Further Notice of Public Rule Making applying for the first time the Communications Assistance for Law Enforcement Act (CALEA) to facilities-based broadband Internet access providers, including higher education institutions, K-12 schools, libraries, and interconnected Voice over Internet Protocol (VoIP) service providers. The Order requires these entities to facilitate lawful requests for surveillance of specific communications on their data networks through a combination of new equipment, trained personnel, policies, and procedures, to be in place within 18 months of the filing of the ruling in the Federal Register.</description>

The current CALEA legislation, also commonly referred to as the &#039;wiretapping law&#039;, gives law enforcement agencies access to communications traffic under specific legal conditions and constraints.</description>

 <title>EDUCAUSE Amicus Brief Before the Supreme Court in Support of Community Networks</title>

 <description>EDUCAUSE filed an amicus (friend of the court) brief before the Supreme Court in supporting the right of municipalities to provide telecommunication services. At issue is whether municipalities fall under the definition of &quot;any entity&quot; under section 253 of the Telecommunications Act of 1996, which prohibits state and local regulations from restricing entities from providing telecommunicaitons services. Many higher education institutions and their surrounding communities, particularly those located in remote areas, are partnering to provide affordable telecommunications services where commercial carriers refuse to deploy. Oral arguments before the Supreme Court are expected to take place in January 2004.</description>
