"Plaintiff Stacy Guin alleges that Defendant Brazos Higher Education Service Corporation, Inc. ("Brazos") negligently allowed an employee to keep unencrypted nonpublic customer data on a laptop computer that was stolen from the employee's home during a burglary on September 24, 2004. This matter comes before the Court on Brazos's Motion for Summary Judgment pursuant to Federal Rule of Civil Procedure 56. For the reasons set forth below, the Court will grant the Motion."

Financial Institutions and Customer Data: Complying with the Safeguards Rule

Many financial institutions collect personal information from their customers, such as their names, addresses and phone numbers; bank and credit card account numbers; income and credit histories; and Social Security numbers. The Gramm-Leach-Bliley (GLB) Act requires financial institutions to ensure the security and confidentiality of this type of information. As part of its implementation of the GLB Act, the Federal Trade Commission (FTC) has issued the Safeguards Rule. This Rule requires financial institutions under FTC jurisdiction to secure customer records and information.

Protecting the privacy of consumer information held by "financial institutions" is at the heart of the financial privacy provisions of the Gramm-Leach-Bliley Financial Modernization Act of 1999. The GLB Act requires companies to give consumers privacy notices that explain the institutions' information-sharing practices. In turn, consumers have the right to limit some - but not all - sharing of their information. This document provides a brief look at the basic financial privacy requirements of the law.

Standards for Safeguarding Customer Information; Final Rule (16 CFR, Part 314)

The Federal Trade Commission is issuing a final Safeguards Rule, as required by section 501(b) of the Gramm-Leach-Bliley Act to establish standards relating to administrative, technical and physical information safeguards for financial institutions subject to the Commission's jurisdiction. As required by section 501(b), the standards are intended to: Ensure the security and confidentiality of customer records and information; protect against any anticipated threats or hazards to the security or integrity of such records; and protect against unauthorized access to or use of such records or information that could result in substantial harm or inconvenience to any customer.

The Gramm-Leach-Bliley Act: Financial Privacy Rule and Safeguards Rule

The Financial Modernization Act of 1999, also known as the "Gramm-Leach-Bliley Act" or GLB Act, includes provisions to protect consumers' personal financial information held by financial institutions. There are three principal parts to the privacy requirements: the Financial Privacy Rule, Safeguards Rule and pretexting provisions. The GLB Act gives authority to eight federal agencies and the states to administer and enforce the Financial Privacy Rule and the Safeguards Rule. These two regulations apply to "financial institutions," which include not only banks, securities firms, and insurance companies, but also companies providing many other types of financial products and services to consumers. As part of an effort to educate consumers and businesses about the importance of personal information privacy, including the security of personal information, the Federal Trade Commission (FTC) has created this web site on financial privacy.
