This document was submitted to the 10th District Federal Appeals Court in Washington DC on March 13, 2006 as part of the ongoing appeal of the FCC Report and Order brought by the higher education community. The FCC Report was issued August 5, 2005 and dealt with the applicability of the Communications Assistance for Law Enforcement Act. This document contains arguments in response to those submitted by the FCC and the DoJ in this case.

Gary Bachula Testimony on Net Neutrality

This was testimony presented before the Senate Commerce Committee on February 7, 2006 during a hearing on Net Neutrality. The testimony was presented by Gary Bachula of Internet2 as support for the position that the most efficient way to manage traffic on networks is through providing more bandwidth, not through the use of QoS.

Higher Education Coalition Comments on Extending Wiretap Law to Internet Providers

EDUCAUSE, along with 15 other education and library organizations has filed comments with the Federal Communications Commission (FCC) in the recently proposed rulemaking regarding the Communications Assistance for Law Enforcement Act (CALEA). While supporting the need for law enforcement to have access to communications under proper legal conditions, the Coalition rejects the FCC attempt to extend CALEA to include broadband Internet access and VoIP (Voice over Internet Protocol).

The Coalition's comments argue two basic points:
(1) the CALEA statute as currently written does not apply to broadband Internet access or to information services, and that only Congress has the power to rewrite CALEA; and
(2) if CALEA is extended to include broadband Internet access and VoIP, then Coalition members need to be clearly and specifically exempted from this obligation.
