FCC Order and Further Notice of Public Rulemaking on CALEA

On September 23, the Federal Communications Commission released an Order and Further Notice of Public Rule Making applying for the first time the Communications Assistance for Law Enforcement Act (CALEA) to facilities-based broadband Internet access providers, including higher education institutions, K-12 schools, libraries, and interconnected Voice over Internet Protocol (VoIP) service providers. The Order requires these entities to facilitate lawful requests for surveillance of specific communications on their data networks through a combination of new equipment, trained personnel, policies, and procedures, to be in place within 18 months of the filing of the ruling in the Federal Register.

Higher Education Coalition Comments on Extending Wiretap Law to Internet Providers

EDUCAUSE, along with 15 other education and library organizations has filed comments with the Federal Communications Commission (FCC) in the recently proposed rulemaking regarding the Communications Assistance for Law Enforcement Act (CALEA). While supporting the need for law enforcement to have access to communications under proper legal conditions, the Coalition rejects the FCC attempt to extend CALEA to include broadband Internet access and VoIP (Voice over Internet Protocol).
The Coalition's comments argue two basic points:
(1) the CALEA statute as currently written does not apply to broadband Internet access or to information services, and that only Congress has the power to rewrite CALEA; and
(2) if CALEA is extended to include broadband Internet access and VoIP, then Coalition members need to be clearly and specifically exempted from this obligation.

Higher Education Comments on Possible FCC Regulation of Internet Services

On May 28, 2004 EDUCAUSE filed comments with the Federal Communications Commission (FCC) arguing that any regulation of Internet-based services, in particular, voice over Internet Protocol (VoIP), should recognize and treat the Internet as a unique technology, distinct from the heavily regulated telephone industry. EDUCAUSE recommends that the FCC adopt an IP-centric regulatory model; refrain from regulating applications except to ensure the provision of vital public services; carefully monitor the infrastructure providers; and develop new funding strategies. The need for revamping the Universal Service Fund to accommodate the transition to IP-enabled services is also discussed.
