This valuable spectrum is expected to be auctioned off in January 2008. The comments ask the FCC to establish rules that would help facilitate a viable third provider for broadband access that would not only provide much needed competition, but would be required to adhere to basic non-discrimination rules. Considerations include rules for: anonymous bidding, exclusion of incumbents or new entrant credit, band plan issues, build-out requirements, designated entities, open access, Carterphone and net neutrality. | | View this resource: | |

The Order requires these entities to facilitate lawful requests for surveillance of specific communications on their data networks through a combination of new equipment, trained personnel, policies, and procedures, to be in place within 18 months of the filing of the ruling in the Federal Register. | | View this resource: | |

At issue is whether municipalities fall under the definition of "any entity" under section 253 of the Telecommunications Act of 1996, which prohibits state and local regulations from restricing entities from providing telecommunicaitons services. Many higher education institutions and their surrounding communities, particularly those located in remote areas, are partnering to provide affordable telecommunications services where commercial carriers refuse to deploy.
