Abstract:As part of the Ad Hoc Public Interest Spectrum Coalition, EDUCAUSE signed on to comments submitted to the FCC regarding the auction rules for the 700 MHz spectrum. This valuable spectrum is expected to be auctioned off in January 2008. The comments ask the FCC to establish rules that would help facilitate a viable third provider for broadband access that would not only provide much needed competition, but would be required to adhere to basic non-discrimination rules. Considerations include rules for: anonymous bidding, exclusion of incumbents or new entrant credit, band plan issues, build-out requirements, designated entities, open access, Carterphone and net neutrality.

Abstract:A coalition of higher education and library associations recently filed a comment with the Federal Communications Commission (FCC) opposing a Department of Justice attempt to bring all broadband access to the Internet within the scope of the Communications Assistance for Law Enforcement Act (CALEA). The current CALEA legislation, also commonly referred to as the 'wiretapping law', gives law enforcement agencies access to communications traffic under specific legal conditions and constraints.
