The U.S. House of Representatives on Thursday overwhelmingly approved a higher-education funding bill that includes controversial new antipiracy obligations for universities.

The 354-58 vote to approve the College Opportunity and Affordability Act leaves intact an entertainment industry-backed provision, which makes up just a tiny part of a bill that has ballooned to more than 800 pages.

A steady stream of press releases from the MPAA and the RIAA about unauthorized peer-to-peer downloading suggests that college students are digital pirates and campus network officials are engaged in benign neglect. Yet ample evidence confirms that unauthorized P2P downloading is primarily a consumer market problem, not especially tied to college students on campus networks. Moreover, the media companies with strong ties to consumer broadband providers are themselves at least indirectly promoting unauthorized P2P activity. This is not new: Media companies have a long history of seeking remedy (and revenue) from Congressional action, rather than pursuing marketplace solutions.

This presentation will focus on how Big Music and Big Hollywood have targeted colleges and universities via press releases and Congressional lobbying initiatives while largely ignoring the much larger amount of unauthorized P2P file sharing taking place on commercial networks.

Earlier this year, in what Casey Green called its "spring offensive," the Recording Industry Association of America stepped up its program of bringing infringement claims against thousands of on- and off-campus users of peer-to-peer file-sharing systems. At the same time, the House Subcommittee on Courts, the Internet, and Intellectual Property held a "Piracy on University Networks" hearing, where one representative warned "the hammer is coming." Meanwhile, forward-looking companies were quietly exploring new business models for distributing entertainment in digital form. Whether based on advertising and ISP licenses, these models take as a given the ubiquity of easy transmission and storage of digital entertainment, both to and among consumers. In this session, we'll explore how the old models are grudgingly giving way to the new, and the implications of this transition for colleges and universities.

Fairfield University has helped faculty incorporate audio and video technology into their curricula to make their content available to students in a digital format. Teaming up with Apple Computer to use iTunes University has simplified the digitizing process for faculty and enabled completely portable content for the students.

With the recent exponential growth of iPods and podcasting among the college-age population, technology-savvy professors have sought to exploit this phenomenon in their classrooms. Since a large percentage of current undergraduates have already embraced the iPod and podcasting (i.e., they own iPods and use iTunes software outside of classes), it seems logical to try to leverage this trend in the academic arena. The question is, how? With all the different hardware and software available that utilizes the iPod and produces podcasts, what is the best way to create digital content from a curriculum so that it can be easily delivered to students and made portable? The answer: iTunes U as implemented at Fairfield University.

Historical Background Just a few years ago, Fairfield's classrooms were not fitted with technology to accommodate digital needs. Professors relied on DVDs or VHS tapes, CDs, or overheads during their classes. As a result, students could not take the content beyond the walls of the classroom. Savvy professors used streaming video to provide content, but this required a student to be on a computer with a broadband network connection. Beginning in 2004, the university initiated a multiyear project to redesign selected classrooms to incorporate new teaching technologies and accommodate the needs of the more technically oriented professors.

The equipment added included video projectors, surround-sound systems, StarBoards, and Star Panels, as well as new DVD and VHS players. The changes were heavily promoted on campus and, along with excellent word-of-mouth advertising, persuaded an entire new group of professors to integrate technology into their coursework.

But professors didn't stop there. Their introduction to new methods of teaching and an increased level of support from IT staff led many instructors to look for ways to promote their content outside the classroom. One method that a number of instructors began experimenting with was podcasting.

etree.org is a music trading site which specialises in making available live recordings ('bootlegs') from trading friendly musicians. Originally a relatively exclusive club, the advent of bittorrent has the music much more accessible to the non-fanatic. Bands such as The Grateful Dead are of course mainstays, but there are also many current bands such as Black Crowes and Phish.

With about a dozen new listings every day, there is lots of music to listen to, even if the breadth of the collection may leave something to be desired.

Titled the Duke First-Year Experience, the iPod initiative was intended to stimulate creative uses of digital technology in academic and campus life. The article below, which appears to be archived now, notes that Watersones is considering an MP3 vending kiosk to sell audio books. Knowing that more people, perhaps students in particular, are carrying MP3 players than CD players, this would seem to make a lot of sense. I'm sure the DRM folks (both hackers and backers) are licking there chops tho'

UNC starts pilot program to allow free file sharing

Higher education officials in North Carolina are beginning a pilot of a multicampus peer-to-peer system for music, movies, and academic file sharing. The system initially will cover four institutions: North Carolina A&T State, Western Carolina, University of North Carolina-Wilmington, and the North Carolina School of the Arts. The University of North Carolina-Chapel Hill and North Carolina State University will be added this spring. If the program goes well, all 16 of the system's campuses could be included. Providing content for the program are iTunes, Ruckus, Cdigix, and Rhapsody; an unnamed music label is providing funding for the pilot. During the pilot, access to content will be provided free, and each institution will be able to select from among the four content providers based on input from students. Although a number of other colleges and universities have instituted campus-wide services for free delivery of online entertainment, the UNC program is the first to be offered across a system of campuses.
